In fact, you do NOT have all of the time in the world to file a personal injury claim. State laws set the statutes of limitation or, in other words, the deadlines before which these claims have to be filed (otherwise people lose their right to pursue civil action).

In Missouri, the statute of limitations for personal injury cases is five (5) years. Although this may seem like a lot of time, it isn’t. What’s more is that the longer people wait to file a case, the less evidence there may be available later to back up their claim. In other words, waiting can decrease the value of a case because there may not be the same evidence available to support it three or four years after an accident has occurred.

Myth #2 – There’s no way to prove fault, so I shouldn’t bother filing a case.
