Pedestrian Accidents And Injuries
Accidents with pedestrians are particularly dangerous given their vulnerability to injury. Many drivers do not respect pedestrians and often times will not grant them the right of way.
Missouri has several laws which pertain to pedestrians and if you are a pedestrian injured in such an accident, you need to be aware of some of the laws which protect your interests.
In Missouri, when traffic control signals are not in place or not in operation, the driver of a vehicle shall yield the right of way, slowing down or stopping if necessary to yield to a pedestrian crossing the roadway within a crosswalk when the pedestrian is upon half of the roadway upon which the vehicle is traveling, or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger.
Pedestrians are required to yield when crossing a roadway at any point other than within a marked cross walk or within an unmarked crosswalk in an intersection. The pedestrian is also required to yield when crossing a roadway at any point where a pedestrian tunnel or overhead pedestrian crossing has been provided. However, Missouri Revised Statute 300.395 establishes areas in which pedestrians are prohibited from crossing. For more Missouri laws pertaining to pedestrians, please click here.
