According to the National Safety Counsel, about 10% of construction workers are injured on the job each year. Falls are the most common cause of injury and result in more fatalities than any other construction accident. The back is the most frequently injured body part on the job accounting for approximately 25% of all work-related injuries. Injuries to the legs, arms, and hands are the next most common injury.

If you are injured on the job during the course and scope of your employment in the state of Missouri you are entitled to benefits under the Missouri Workers’ Compensation Law. Furthermore, if you are injured at a location not under the control or ownership of your employer, you may have a separate cause of action against the person or corporation maintaining control or ownership of the property. In Missouri, if you are injured in the scope and course of your employment you do not have to prove that your employer was negligent in causing you injuries; rather you must simply prove that during your regular work-related duties, you were injured. On the other hand, in order to recover against a liable third party when injured at an off-site facility or location not controlled, maintained, or owned by your employer, ordinarily you must prove negligence.

Certain on the job injuries are governed by the Occupational Safety and Health Act of 1970, (OSHA) whereby employers are responsible for providing a safe work environment for their employees. OHSA establishes and enforces safety standards and provides consultation and educational programs to help prevent work-related accidents.
